Novokuznetsk became the fifth city in which the lawyers of our bar held thematic seminars on land, real estate and construction: earlier such events were held in Kemerovo, Novosibirsk, Belovo and Mezhdurechensk.
The first part of the seminar was devoted to land payments. As is known, since January 1, 2016, a new assessment of the lands of settlements has been in force in Kuzbass, in this regard, the main attention was paid to the issues of challenging the cadastral value in the Commission at Rosreestr and in court. Considerable attention was also paid to issues related to the calculation of rent. In particular, the April changes in the Resolution of the Collegium of the Administration of the KO No. 47 dated 05.02.2010, which changed the calculation procedure and rental rates for land plots in the Kemerovo region (except for the regional center), were analyzed in detail.
The presenters of the seminar specifically focused on the changes in the field of cadastral valuation that await us in 2017 in connection with the entry into force of the Federal Law “On State Cadastral Valuation”.
In the second part of the seminar, problems related to the formation of land plots, their provision for construction and registration of rights to land under real estate were discussed. A number of questions from the seminar participants were related to the use of land plots without the provision and establishment of an easement, including for the purpose of locating linear facilities. Developers are also concerned about the possibility of withdrawing objects of unfinished construction after the expiration of the lease agreement.
Both practicing lawyers and real estate owners, appraisers and even representatives of municipal authorities from Prokopyevsk took part in the seminar. As a result, the participants could talk about their diverse experiences, discuss the most pressing issues "from different sides of the barricades" and try to jointly find a solution to the most pressing problems.
The Yurproekt company plans to continue cooperation with the Regional Center for Economics and Business LLC, including holding a similar seminar in October 2016 in Belovo.
